SEX, PROSTITUTION, RAPE AND HOMOSEXUALITY


Zina
Abstract
Zina is an Islamic term referring to sexual intercourse between people of the same or opposite gender. Zina in its broad meaning indicates any haram act, whether the act was sexual intercourse  or a physical desire that is related or may lead to illicit sexual relations:
Ø Homosexuality and heterosexuality
Ø adultery and fornication
Ø  rape and prostitution
Ø beastiality
Types of Zina
      Zina of Eyes
       Zina of Hands
       Zina of Ears
       Zina of Feet
       Zina of Tongue
According to Islam
Allah has written the very portion of zina which a man may indulge in.
There will be no escape from it.  The zina of the eye is the lustful look, the zina of the ears
 is the listening, the zina of the tongue is the speech, the zina of the hand is the grip, the

zina of the feet is the walking (to the place to commit zina), the heart yearns and desires
and the private parts approve all that or disprove it.”

Zina of eyes
Zina of eyes is to look or stare at the the opposite gender or same gender with bad
intention.

ALLAH MENTIONS IN QURAN:
                                  Tell the believing men to lower their gaze (from looking at forbidden things), and guard their modesty(from illegal sexual acts)…

ZINA OF HANDS
Zina of hand means to touch a person of same or opposite gender with bad intentions.
For one of you to be stabbed in the head with an iron needle
is better for him than that he should touch a woman who is not permissible for him.”                                                                                                   
                                                             [Saheeh al-Jaami’, 5045]   
ZINA OF EARS
Zina of ears means to listen to such things that lead one to develop illegal relations and to listen to such things that makes a person to develop bad intentions.
ZINA OF FEET
  Zina of feet means that to walk to place which would result in illegal relationships and adultery as mentioned by Islam.
ZINA OF TONGUE
Zina of tongue is sinful speech that expresses inner self wishes and desires that lead a person towards sins like zina.

Rape
      Rape is the act of having Un-consensual sex with another person. It is extremely prohibited in Islam. It is regarded as a violation of moral and divine law.
       What distinguishes rape from zina is the simple act of consent. For it to be established as rape, one party has to force itself on to the other via means of physical force, blackmail or if the other party is unconscious.
Punishments for Rape
      Hadd of Zina
      Some scholars are under the opinion that rape should be treated as Hadd of Zina and a convicted rapist should be stoned to death, provided that they are married. On the other hand an unmarried individual is subjected to a 100 lashes.
      Hadd of Hirabah
      Some scholars classify it as an act of fasad (destructive mischief) Thus, the rapist will be considered to be under the category of people who are outlaws and a danger towards the peace and security of the society.
      Ta’azir
      Ta’azir are punishments which haven’t been defined in the Quran or Hadith. They are at the discretion of the state, governing body or a judge/court. It is possible for a victim to make a claim for moral damages, which may include violation of a person’s freedom, dignity, reputation, social or financial status
Homosexuality
      Homosexuality is defined as sexual interest in and attraction to members of one’s own sex.  Homosexuality is strictly prohibited in Islam and is punishable by stoning, flogging or lashes.
It is stated in the Quran:
                                               “We also sent Lot: He said to his people: ‘Do you become such shameless as no people in creation ever committed before you? For you practice your lusts on men in preference to women: ye are indeed a people transgressing beyond bounds.”
                             [7:80-81]



 IN HADITH:                                                                                                        
          “If you find anyone doing as Lot's people did, kill the one who does it, and the one to
  whom it is done.”
                                                                                                                                 (Sunan Abu Dawood, 38:4447)

Adultery and Fornication
      Fornication is generally consensual sexual intercourse between two people not married to each other. When one of the partners to consensual sexual intercourse is a married person, it may be described as  adultery.
      “But there came after them an evil generation, who neglected prayers and followed the sexual desires, so they will meet perdition.” (Surah Maryam 19:59)
Punishment for fornication
“As for the  fornicatress and the fornicators, flog each other of them, (giving) a hundred lashes, and let not pity for them detain you in the matter of obedience to Allah, if you believe in Allah and the Last Day, and let a party of believers witness thischastisement.”  (Surah an- Nūr 24:2)
Married
If married person commits adultery, he gets stoned to death
Unmarried
If someone who is unmarried commits fornication, he gets the punishment of 100 lashes
Prostitution
Prostitution is the business or practice of engaging in sexual activity in exchange for payment. Prostitution is sometimes described as sexual services, commercial sex or, colloquially, hooking.
IN THE LIGHT OF  HADITH:

“There is no prostitution in Islam. If anyone practiced.
prostitution in pre-Islamic times, the
child will be attributed to the master (of the slave-woman). He who claims his child
without a valid marriage or ownership will neither inherit nor be inherited.”

CONCLUSION:
Zina is strictly prohibited in islam despite of its type it affects a person sprituality.  It takes a person away from Allah Almighty and is a cause of ultimate guilt for a   Person.  In Islam nothing is haram that is beneficial for person but the things that affects person and society are not allowed in religion IslaM.  Zina is a cause of disgrace for a person and his particular society . As the main purpose of Islamic Shariah is to preserve the honour of man and women that is why zina is considered as a major sin and that is why various ways have been mentioned in Quran and Hadith to be prevented from Zina
      Example:
             Hijaab has been mentioned to protect men and women from evil gaze and that is why it is mentioned to lower one’s gaze. So should protect oneself from this evil sin so that he can become nearer and dearer to Allah.
